Het niet beschikbaar zijn van voldoende personeel kan het tenderproces frustreren hetgeen de kwaliteit van de inschrijving niet ten goede komt, en het kan aannemers zelfs weerhouden in te schrijven. Dit is een situatie die voor inschrijvers, maar ook aanbestedende diensten onwenselijk is. Wel is in artikel 1.10 lid 1 en artikel 1.10 lid 2 sub e Aanbestedingswet bepaald dat een aanbestedende dienst bij een aanbesteding in ieder geval acht dient te slaan op de redelijkheid van de te hanteren termijnen. Interessanter nog is Voorschrift 3.6 van de Gids Proportionaliteit die de verplichting dat er per opdracht kritisch moet worden overwogen of de gehanteerde termijnen re\u00ebel en proportioneel zijn in relatie tot de te ondernemen acties voor de aanbesteding. De Gids stelt daarbij dat een gestelde termijn er niet voor moet zorgen dat een belangrijk deel van de inschrijvers wordt uitgesloten of geen gedegen inschrijving kan doen. Zo is het denkbaar dat een (hoofd)aannemer wel voldoende capaciteit heeft om een inschrijving voor te bereiden in de vakantieperiode, maar voor zijn (kleinere) onderaannemer(s) kan dit een ander verhaal zijn. De Gids geeft aan dat het proportioneel is om tijdens de vakantieperiode de wettelijke aanbestedingstermijn te verlengen met een periode die gelijk staat aan de duur van de vakantieperiode. Dit niet alleen vanwege het belang van een optimale marktwerking, maar ook om de rechtsbescherming niet onnodig in te perken. De aanbestedende dienst mag afwijken van wat er in de Gids Proportionaliteit staat, maar dan dient zij dit voldoende te motiveren aan de hand van het specifieke geval.<\/p>\n

Het uitgangspunt uit Voorschrift 3.6 Gids Proportionaliteit wordt ook al heel lang onderschreven door grote aanbestedende diensten zoals Rijkswaterstaat en ProRail. Al in 2008 hebben zij de conclusie
\ngetrokken dat het \u2018evident ineffectief\u2019 is om tijdens de bouwvak of de Kerstvakantie aan te besteden, overigens ook vanwege ondercapaciteit aan de zijde van de aanbestedende kant. Het is daarom commercieel onverantwoord om de termijn in dat geval niet op te schuiven. Hoewel een langere inschrijftermijn wettelijk gezien niet direct bij de aanbestedende dienst valt af te dwingen, zijn er dus toch ruim voldoende (juridische) haakjes om een verlenging te bewerkstelligen.<\/p>\n
